Confidentiality & Secrecy

For detective agencies with a license from the Ministry of Justice, the same applies as the professional secrets associated with certain professions. For example, doctors, general practitioners, surgeons, accountants, pharmacists, lawyers, psychologists, private researchers and sworn civil servants are not allowed to reveal secrets that customers have entrusted to them.

Investigation agencies maintain strict confidentiality with regard to everything that has become known when entering into and executing an agreement, unless there is a legal obligation to give evidence or if such information relates to a criminal offense and is provided to the police in accordance with the provisions of Article 4.3. The duty of confidentiality also extends to the identity of the client.

Penalties for those who fail to observe this duty of confidentiality are not mild (art. 272/273 Penal Code). Disclosure of professional secrets can result in a maximum sentence of six months in prison. Moreover, you risk losing the permit to carry out the work or even a suspension from the professional association or Justice.

According to the law, there are only the following options for making the information from an investigation or customer data 'public / known / transparent':

◎ The client gives explicit permission
◎ A judge explicitly requests this information
◎ The client (private person) has died
◎ The client (company) has been dissolved

Independent truth finding

Truth finding is always of paramount importance. Any detective agency will focus the investigation on this truth finding. Sometimes the result is satisfactory for the customer, but it certainly also happens that this finding of truth does not fall 'in the vein' of the client.

A private investigator should always conduct an investigation independently and report regardless of what the client would like to hear.

Although a private investigator is usually employed in civil law to, for example, obtain evidence legally independently (a report from a detective agency is valid evidence and statements are made as an expert witness), findings are also sometimes used in criminal law.

Namely, where many reports to the police are not investigated due to lack of manpower to collect evidence, evidence provided by a criminal investigation agency (private detective) is an easy way to score and these types of reports are often handled.
